Lithuanian Authority Refuses to Investigate Complaint Alleging Port Operator Abuse

Vilnius, December 9, 2025 — The Lithuanian authority has refused to open an investigation into alleged abusive conduct by Klaipėda Stevedoring Company, finding that the complaint did not meet its enforcement-priority threshold.

Scrap-metal exporter Tolmeta alleged it was forced to rent specialised cargo-handling equipment exclusively from the port operator at unilaterally imposed, higher-than-agreed prices. Tolmeta argued that these terms constrained its ability to operate and could amount to an abuse of dominance.

Authority’s Assessment

After reviewing the materials, the authority found no indication that the disputed conduct affected a significant share of Lithuanian market participants or consumers. Tolmeta’s customers are located abroad; therefore, any impact from the dispute would be felt outside Lithuania and would not advance domestic consumer welfare.

The authority concluded that the matter was essentially a contractual dispute better suited for civil litigation and that a formal investigation would not represent a proportionate or efficient use of resources.

Next Steps

Tolmeta may challenge the decision before the Regional Administrative Court within one month of notification or publication on the authority’s website.
