Warsaw, November 13, 2025 — The Polish authority has opened a preliminary probe into whether Posnet Polska coordinated retail prices for its fiscal devices with distributors, conducting dawn raids at the company and three partners as part of the inquiry.
Officials searched the premises of Posnet Polska and distributors Esc (Kraków), Segal (Opole), and Dotkom (Tychy) after an initial review suggested that online prices for fiscal cash registers, payment terminals and barcode scanners were identical or nearly identical across retailers.
Concerns
According to the authority, the suspected arrangement may have prevented retailers from offering Posnet equipment below centrally set prices, potentially restricting discounting and harming buyers of fiscal devices. Evidence seized during the searches is now being analysed.
The investigation is currently “in rem,” not directed at any specific company. If the evidence confirms the suspicions, the authority will open formal antitrust proceedings and issue charges.
Enforcement and Leniency
Companies found to have participated in a price-fixing agreement face fines of up to 10% of turnover, while responsible managers may be fined up to PLN 2 million. The authority reminded businesses that leniency remains available to participants who provide evidence and cooperate as “crown witnesses.”
