Canadian Authority Consults on Updated Merger Enforcement Guidelines

Gatineau, November 13, 2025 — The Canadian authority has launched a public consultation on its updated Merger Enforcement Guidelines, seeking feedback from businesses, practitioners, and the public following major recent amendments to the Competition Act.

The proposed guidelines revise the Bureau’s 2011 framework, updating it to reflect new legal powers, current enforcement practices, and shifts in the Canadian economy. The updates are intended to clarify how the authority assesses mergers under the modernised statutory regime, including changes adopted between 2022 and 2024 to strengthen oversight of anti-competitive transactions.

The authority previously held an initial consultation during its review process, and the feedback received has informed the adjustments now released. With the publication of this draft, the authority aims to ensure transparency and provide businesses with clear compliance expectations as merger rules evolve.

Interested parties may submit comments on any aspect of the proposed guidelines until February 11, 2026. Submissions will be made public unless confidentiality is requested. After reviewing the input, the authority will publish its final guidelines, which will outline its current approach to merger reviews under the amended Act.
