UK High Court Rules Against Environmental Groups on Confidentiality in Mercedes-Benz Emissions Litigation

In a landmark ruling on December 11, 2024, the High Court addressed the confidentiality of technical documents disclosed in the NOx Emissions Group Litigation against Mercedes-Benz.

The case involves allegations of emissions manipulation and features multiple claimants, environmental groups, and government bodies as parties.

The ruling focused on Mercedes-Benz’s application to restrict the use of commercially sensitive information from documents disclosed during a preliminary trial concerning Germany’s Federal Motor Transport Authority (KBA) approvals. Justice Constable granted partial protection, allowing redactions for commercially sensitive details not directly relevant to the trial’s public understanding.

The court emphasized the principle of open justice but acknowledged that technical information related to current vehicle production could unfairly benefit competitors if released. Justice Constable highlighted that future trials may reassess confidentiality, especially if the documents play a more central role.

Environmental groups ClientEarth and Deutsche Umwelthilfe had sought access to unredacted documents, arguing the public interest in scrutinizing emissions compliance. The court, however, found their access unnecessary for understanding the trial’s outcomes, balancing this against the potential commercial harm to Mercedes-Benz.

This ruling underscores the tension between transparency in litigation and protecting sensitive corporate data, setting a precedent for future cases involving technical disclosures.
