CADE Launches Public Consultation for New Leniency Guide Update

The Administrative Council for Economic Defense (CADE) has opened (7 November) a public consultation to gather feedback on its updated Leniency Guide, inviting input from the public and legal experts. This initiative, which runs through December 20, was announced at the 30th International Seminar on Competition Defense and aims to enhance transparency and efficiency in CADE’s leniency program.

The update is the result of extensive work by CADE’s Antitrust Leniency Working Group, formed by the General Superintendence in 2023. This year, the group held six collaborative meetings with nearly 100 participants, including stakeholders from outside the agency, to discuss improvements to the leniency agreement process. The current update marks the first major revision of the guide since 2017.

Deputy Superintendent General Fernanda Machado emphasized the importance of public contributions, noting that the collaborative efforts have aimed to make leniency agreements more efficient while maintaining legal certainty. “Strengthening the dialogue between all those involved in the leniency process is essential to reach faster and more efficient agreements, without sacrificing legal certainty,” she stated. “With contributions from multiple agents, we can improve negotiations and ensure investigations conclude more accurately, benefiting society with quicker and more reliable outcomes.”

The new draft of the Leniency Guide is now accessible for public comment through Brazil’s Participa + Brasil platform, where stakeholders can submit their feedback until December 20.
