Canada’s Competition Bureau Investigates Dye & Durham Practices

The Competition Bureau Canada has obtained a court order to advance its investigation into alleged anti-competitive practices by Dye & Durham Limited, a provider of conveyancing software used in real estate transactions.

The order, granted by the Federal Court, mandates Dye & Durham to produce documents and information relevant to the Bureau’s inquiry into potential violations of the Competition Act’s restrictive trade practices provisions, including abuse of a dominant position.

This investigation focuses on whether Dye & Durham’s business practices might be restricting competition within Canada’s conveyancing software market, potentially limiting other software providers’ access to legal practitioners who rely on these tools for real estate transactions. Conveyancing software is essential in real estate, supporting lawyers and agents with the transfer of property titles, making competitive access crucial for choice and innovation.

The Bureau has emphasized that the investigation is ongoing and has not concluded any wrongdoing on the part of Dye & Durham at this time.
