Peru’s Indecopi Fines Clinic For Misleading Advertising Of Medical Campaign

Lima, March 2, 2026 — The Specialized Chamber for the Defense of Competition (SDC) of Peru’s competition authority Indecopi has fined Tecnologías Médicas Arequipa S.A., operating as Clínica Emmel, for misleading advertising related to a medical campaign.

In a second administrative instance decision, the SDC imposed a fine of 11.15 tax units (UIT), equivalent to PEN 59,652.5, for engaging in acts of unfair competition in the form of deception.

According to the investigation, the clinic advertised a prostate cancer screening campaign suggesting that one of the participating professionals held a medical specialty in urology. During the proceedings, however, the provider was unable to substantiate that the professional had the advertised specialty.

The conduct was found to violate Article 8 of Legislative Decree No. 1044, the Law on the Repression of Unfair Competition.

As a corrective measure, the chamber ordered the clinic to permanently cease dissemination of the disputed advertisement and any similar advertising that could mislead consumers unless the claims made are accurate. Failure to comply may lead to further sanctions.

The chamber’s ruling confirmed a prior decision by the Commission of Indecopi’s Regional Office in Arequipa, which initiated the investigation ex officio after reviewing the promotion of the medical campaign published on the provider’s Facebook page.

Indecopi said the decision reaffirms its commitment to protecting consumers and promoting fair competition, particularly in the health services sector.
