Latvia’s Competition Council (KP) has carried out procedural actions at the premises of two companies as part of an investigation into a suspected illegal agreement in the landfill leachate treatment sector.
The authority said the actions were conducted on Dec. 17 after it obtained information suggesting that at least two companies may have exchanged commercially sensitive information, agreed on market sharing and coordinated participation conditions in public tenders related to the operation of landfill leachate treatment technologies and the supply of chemicals.
KP said such horizontal agreements, including bid rigging and cartels in public procurement, are among the most serious competition law infringements. Companies found to have participated could face fines of up to 10% of their annual net turnover and be barred from participating in public procurement procedures for three years.
The watchdog stressed that no infringement has been established at this stage and that any violation can be confirmed only at the end of the investigation, after all evidence has been collected and assessed. It added that the scope of the probe could be expanded or narrowed and encouraged potential participants to come forward under its leniency programme in exchange for reduced or waived fines.
