Pretoria, November 3, 2025 — South Africa’s Competition Commission (CompCom) has invited public comment on its draft guidelines for the pre-merger filing consultation process, which aim to streamline merger assessments and reduce procedural delays.
New Framework for Early Engagement
The draft guidelines set out a structured process for merging parties and sellers to engage with the CompCom prior to formally notifying a transaction. The initiative is designed to allow companies to clarify issues and requirements related to proposed mergers, ensuring a smoother and more efficient review once filings are made.
According to the Commission, this early consultation framework is intended to promote constructive engagement, allowing potential concerns to be addressed upfront and thereby expediting the overall merger review process.
