Ukraine’s AMCU Fines Bid-Rigging Firm, Grants Leniency to Other

Kyiv, October 30, 2025 — The Antimonopoly Committee of Ukraine (AMCU) has imposed a fine of UAH 318,142 (approximately $7,565) on Elit-Bud 2 and exempted an individual entrepreneur from liability in a case concerning bid rigging during a 2024 tender for the capital repair of a fire water supply network organized by PJSC Ukrnafta.

The AMCU found that Elit-Bud 2 and the entrepreneur engaged in coordinated conduct that distorted tender results and eliminated competition between them.

During the investigation, the entrepreneur applied for full immunity under the AMCU’s leniency framework, disclosing details of the collusion, ending their participation, and fully cooperating with the authority. As a result, they were granted complete exemption from fines, while Elit-Bud 2 was fined UAH 318,142.

The AMCU reiterated that leniency applicants who voluntarily report and assist in uncovering collusion may avoid penalties under Ukrainian law.
