New Zealand Issues Guidance on Collaboration During Emergencies

WELLINGTON — The New Zealand Commerce Commission has issued guidance reminding businesses that emergencies cannot be used as a justification for cartel conduct or other anti-competitive behaviour.

The guidance explains how companies may collaborate during crises to maintain the supply of goods and services, while warning that practices such as price fixing or market allocation will not be tolerated.

The commission said the document sets out the factors it will consider when assessing emergency cooperation between businesses and deciding whether to investigate or take enforcement action.
