Swiss Watchdog Drops Swisscom Probe After Court Setback

Bern, September 16, 2025 — Switzerland’s Competition Commission (ComCo) has closed its follow-up investigation into telecoms group Swisscom after the country’s highest court overturned an earlier finding of market abuse.

ComCo had been examining Swisscom over its alleged dominant position in the broadband networking of corporate sites, following complaints that the company obstructed rivals and charged excessive prices. The latest probe, launched in 2020, was related to a previous case dating back to 2015.

In the 2015 investigation, the agency fined Swisscom for alleged anticompetitive conduct in a tender to connect Swiss Post locations via broadband. However, in March 2024, the Federal Supreme Court struck down ComCo’s decision, ruling that Swisscom had not abused its market power.

Since the follow-up probe concerned the same business practices, the authority said it had no basis to continue proceedings and has now dropped the case.

The authority noted that its decision can still be appealed before the Federal Administrative Court.
