Spain Ends Most Wholesale Broadband Regulation as Competition Strengthens

13 August 2025 – Spain’s competition and telecoms regulator has scrapped most wholesale fixed broadband rules, saying growing competition means Telefónica no longer needs to be bound by regulated terms for its fibre services.

The National Commission on Markets and Competition (CNMC) confirmed it will lift obligations on the company’s NEBA Local and NEBA Fiber wholesale products, which have applied to about 30% of the population since October 2021. These services will now be offered under commercial terms across the country, with competition law and sectoral dispute resolution rules applying instead.

The decision follows a marked improvement in market conditions, including wider fibre-to-the-home coverage, Telefónica’s retail market share falling below 50% in regulated areas, and the rise of rivals such as MÁSORANGE, Digi, and wholesale players Onivia and Lyntia.

A six-month transition period will keep current rules in place before deregulation takes full effect. Regulation of access to Telefónica’s physical infrastructure — including conduits and poles — will remain while the CNMC completes its separate review of that market.
