21 May 2025 — The Office for the Protection of Competition has acknowledged the Constitutional Court’s ruling on the legality of its unannounced inspection of betting company TIPSPORT, carried out over six years ago.
The Court criticized the Office for insufficient documentation of meetings and inadequately prepared preliminary investigation records. However, the Office noted that its procedures have since evolved significantly, with current practices including detailed administrative files and strengthened legal reasoning.
The ruling, which included a dissenting opinion, reflects the legal complexity surrounding such inspections, particularly given differing views between courts. The Office also pointed out that a similar complaint by FORTUNA GAME was rejected by the Constitutional Court in 2023.
Emphasizing the importance of local investigations for uncovering serious anti-competitive behavior, the Office stated it continues to work towards legal clarity, including dialogue with judges and legal experts.
