The Autorité de la concurrence has issued a conditional opinion on a collective agreement in the private-hire vehicle (PHV) sector, warning of potential competition risks. The agreement, signed in December 2023, would require platforms to allow drivers to set a minimum income per kilometer, ranking journey offers accordingly.
While the agreement itself is not deemed anticompetitive, the Autorité highlights concerns that only Uber currently has the technology to implement such a system. This could reinforce Uber’s dominant position and create barriers for competitors. Given the potential exclusionary effects, the Autorité recommends an in-depth impact study before approval.
The French employment platforms social relations authority (ARPE), responsible for approving the agreement, is urged to balance social benefits with competition risks and ensure regulatory safeguards.
