The European Commission has opened a public consultation on proposed amendments to the State Aid Implementing Regulation and Best Practices Code, aiming to enhance public access to justice in environmental matters. The reforms introduce a mechanism allowing citizens to request a review of State aid decisions that may breach EU environmental law.
This move follows the Aarhus Convention Compliance Committee’s 2021 findings that the EU lacked sufficient legal avenues for the public to challenge such decisions. Stakeholders can submit comments until 21 March 2025. The Commission plans to finalise the amendments in Q2 2025.
