Lithuanian Competition Council Receives Bank Guarantee for Fine, Halts Forced Recovery

The Lithuanian Competition Council has decided not to pursue forced collection of a €100,950 fine imposed on the company Filmai ir kvapai after receiving a bank guarantee confirming payment.

The fine was part of a broader €1,415,520 penalty levied against Giantera, the official distributor of Dr. Ohhira products in Lithuania, and 19 other distributors for coordinating prices and restricting discounts on food supplements and cosmetics.

While Filmai ir kvapai appealed the decision to court, it submitted a bank guarantee on 13 December 2024, ensuring the fine will be paid into the state budget. Under Lithuania’s Competition Law, violators must either pay fines within three months or provide financial guarantees to delay forced recovery during court proceedings.

The Council confirmed that interest on the unpaid fine will not accrue during the litigation process, as the bank guarantee satisfies legal requirements. The fine payment deadline remains set for 14 February 2025.
