As of December 26, 2024, amendments to the Competition Law have empowered the Competition Council (CC) to offer methodological support to public contracting authorities in identifying and assessing losses caused by competition law violations. Under the new provisions, the CC will advise authorities on damage assessment, calculation methods, and preparing claims for court submission.
The CC’s role in this process will be distinct from its investigative functions to avoid conflicts of interest. The guidance provided will be advisory and non-binding, focusing on supporting authorities with damage recovery.
Juris Gaiķis, Chairman of the Competition Commission, emphasized the importance of recovery for public contracting authorities and consumers, urging them to seek the Commission’s assistance. Despite awareness of the possibility of compensation, a 2024 survey revealed only 18% of authorities had considered pursuing loss recovery. In the first year, the Commission plans to focus on educating authorities and publishing guidelines to help them navigate the new provisions.
