BRASÍLIA, March 18, 2026 — Brazil’s competition authority has launched a public consultation to gather input on new guidelines governing collaboration between competing companies.
The Administrative Council for Economic Defense said the initiative aims to provide greater clarity and predictability in assessing cooperation arrangements such as joint ventures, industry associations and innovation projects.
The proposed guidance seeks to help distinguish between pro-competitive collaborations that generate efficiencies and those that may pose risks, particularly where sensitive information is exchanged or market conduct is coordinated.
Cade said the guidelines are intended to improve legal certainty for businesses and advisers while supporting consistent enforcement.
Stakeholders can submit comments through the government’s consultation platform until May 4, 2026.
