Kazakh Agency Fines Turkistan International Airport For Abuse Of Dominance

Astana, February 23, 2026 — Kazakhstan’s Agency for Protection and Development of Competition (APDC) has fined JSC Turkistan International Airport KZT 14.3 million (approximately $28,617) for abuse of dominance in the aviation fuel retail market.

The APDC’s Turkistan regional department conducted an analysis of competition conditions in the retail sale of aviation fuel and identified signs of a breach of Article 174(4) of the Entrepreneurial Code of Kazakhstan.

Abuse Of Dominant Position

Following the findings, the department initiated an investigation into JSC Turkistan International Airport for imposing additional obligations unrelated to the subject of agreements.

The investigation determined that the airport held a dominant position in the relevant market and charged a retail aviation fuel supplier a fee for the right to operate within the airport’s territory.

The department concluded that this conduct constituted a violation under Article 174(4) of the Entrepreneurial Code, which prohibits abuse of a dominant position, including the imposition of unjustified contractual terms.

Court Decision

By decision of the Specialised Interdistrict Administrative Court of Turkistan, JSC Turkistan International Airport was held administratively liable under Article 159(3-1) of the Code of Administrative Offences.

The court imposed an administrative fine of KZT 14.3 million.

The case highlights continued enforcement by the Kazakh authority against abuses of dominance in infrastructure-related markets, including airport services.
