MADRID, February 25, 2026 – The Spanish National Commission on Markets and Competition (CNMC) has declared that Apple and Amazon failed to comply with a cease and desist order imposed in its 2023 sanctioning resolution concerning anti-competitive clauses in their distribution agreements.
In July 2023, the CNMC fined the two companies €194 million for including anti-competitive clauses in contracts governing Amazon’s conditions as a distributor of Apple products. According to the authority, the clauses unfairly restricted the number of Apple product resellers on Amazon’s website in Spain, limited advertising space for competing products, and prevented Amazon from directing marketing campaigns to Apple customers to promote competing brands.
In its 2023 resolution, the CNMC required Apple and Amazon to take the necessary measures to cease the sanctioned conduct.
The clauses restricting the number of Apple resellers on Amazon and limiting advertising space for competing products were removed in May 2025.
On October 1, 2025, the CNMC Council declared that the companies had failed to comply with the July 2023 resolution, as they did not cease the sanctioned conduct until May 2025, after receiving a non-compliance proposal from the Competition Directorate.
The Council has requested the Competition Directorate to initiate a new sanctioning procedure due to evidence of infringement arising from the non-compliance, without prejudice to the final outcome of that procedure.
The CNMC’s decision has been appealed before the National Court and is pending judgment.
