Spanish Authority Plans to Update Corporate Compliance Guide

Madrid, December 9, 2025 — The Spanish authority has launched a public consultation to update its five-year-old guide on corporate compliance, aiming to align the document with recent legislative changes and the practical experience gained since its publication.

The CNMC’s 2020 guide has become a reference point for assessing competition-law compliance programmes across the Spanish industry. Its criteria have since been treated as a de facto standard for evaluating companies’ internal controls and the incentives they implement to prevent infringements.

The authority now plans to revise the guide to reflect economic developments, regulatory updates, and lessons drawn from enforcement actions over the past half-decade.

The consultation is open to companies, business associations, legal advisers, consultants, and any stakeholders active in compliance. Submissions may be filed through the CNMC’s online platform until January 20, 2026.
