Austria’s Cartel Court Fines Kienzl $52K for Bid-Rigging in Construction Sector

Vienna, October 1, 2025 — Austria’s Cartel Court has imposed a fine of €45,000 (approximately $52,830) on Kienzl for participating in illegal price-fixing, market allocation, and information exchange in the country’s construction sector.

According to the court’s findings, Kienzl engaged in anticompetitive coordination between at least September 2012 and April 2017, specifically in public and private tenders for building construction projects (Hochbau) in the Burgenland region.

The company took part in price agreements, bid rigging, and market allocation designed to divide contracts among competitors. In some cases, firms agreed on which company would win a tender, what price would be offered, or that certain rivals would abstain from bidding altogether.

Although Kienzl did not act under the formal leniency program, it cooperated extensively with the Federal Competition Authority (BWB) to clarify the facts and admitted its involvement in the infringement. Given the company’s secondary role, modest size, and limited financial capacity, the BWB recommended a reduced penalty, which the court accepted.
