Brussels, September 17, 2025 — The EFTA Surveillance Authority (ESA) is consulting on Nordic electronics retailer Elkjøp‘s proposed commitments to address concerns in an abuse of dominance investigation.
In May 2023, the ESA opened antitrust proceedings, and in a preliminary assessment in June 2025, said that Elkjøp may hold a dominant position in one or more Norwegian retail markets for consumer electronics. The authority is concerned that the company compelled or incentivised suppliers to limit supplies to specific rivals, potentially infringing Article 54 of the EEA Agreement.
Under the proposal, Dixon Stores Group Retail Norway AS, Elkjøp Nordic AS, and Elkjøp Norge AS commit to not agree with suppliers on no or reduced distribution—or less-favourable terms—to named competitors in Norway, nor request or incentivise such outcomes.
The retailers also agreed to send an annual standard letter informing all current and future suppliers of these commitments and provide annual competition-law training to relevant commercial and purchasing staff.
The commitments would apply for five years from entry into force and may be extended up to five additional years if needed. ESA has published a market-test notice summarising the measures
