On March 19, 2025, the Administrative Council for Economic Defense (CADE) Court sentenced two companies and nine individuals involved in an international cartel affecting the global television market. The court’s decision pertains to anti-competitive behavior in the color image tube (CPT) market, a key component used in television manufacturing, with significant impacts in Brazil.
The illegal conduct allegedly took place from the late 1990s until 2007. The court, led by Rapporteur Camila Pires Alves, examined a comprehensive set of evidence, including reports, meeting minutes, and direct testimony from Leniency and Cease and Desist Agreements (TCCs) submitted by the parties involved. These documents detailed exchanges of competitively sensitive information between competitors, as well as their participation in coordinated meetings aimed at manipulating production, pricing, and market distribution.
In her ruling, Alves emphasized the importance of corroborating evidence, stating that while Leniency Agreements and TCCs provide valuable insight into cartel activities, they must be supported by additional documents for validity. The cartel’s conduct was found to involve frequent bilateral and multilateral meetings between CPT manufacturers, where they colluded to set prices, allocate markets, and share sensitive production data.
The companies condemned in this case include Orion Electric Corporation Ltd. and Thai-CRT Company Limited, along with nine individuals associated with the cartel. The financial penalties imposed total over R$18.5 million, with the fines due within 30 days of the final judgment. This ruling marks a significant step in addressing global anti-competitive practices within the electronics manufacturing industry.
The case is a reminder of CADE’s commitment to enforcing fair market practices and its role in curbing anti-competitive behavior that harms both consumers and the economy.
