Lagos, February 9, 2025 – The Federal High Court in Lagos has upheld the Federal Competition and Consumer Protection Commission’s (FCCPC) authority to regulate competition and consumer protection across all sectors, including telecommunications.
The ruling, delivered on February 7, 2025, dismissed a case by Emeka Nnubia, a shareholder of MTN, who sought to halt the FCCPC’s investigation into the telecom giant. The court affirmed that the FCCPC’s mandate under the Federal Competition and Consumer Protection Act (FCCPA) 2018 supersedes conflicting provisions in the Nigerian Communications Act (NCA) 2003, ensuring concurrent jurisdiction between the FCCPC and the Nigerian Communications Commission (NCC).
