Czech Office Clarifies Landmark EU Court Ruling on Third-Country Suppliers

January 23, 2025 – The Czech Office for the Protection of Competition has issued an interpretative opinion for contracting authorities regarding the Court of Justice of the EU’s (CJEU) judgment in Case C-652/22 Kolin Inşaat Turizm Sanayi ve Ticaret, dated October 22, 2024.

The ruling addresses participation conditions for suppliers from third countries lacking international agreements with the EU. The Office clarified that Czech law prohibits discrimination against such suppliers but does not guarantee them equal treatment in public procurement.

This interpretation guides authorities on applying procurement rules while adhering to the principles of equal treatment and non-discrimination, except where international agreements are absent.
