Indonesia’s KPPU Opens Preliminary Hearing on Alleged SANY Truck Market Dominance

Jakarta, January 21, 2025 – The Indonesian Competition Commission (KPPU) today conducted the Preliminary Commission Hearing for Case No. 18/KPPU-L/2024.

This case investigates alleged anti-competitive practices and market domination by SANY Group in the sale of SANY trucks in Indonesia. The hearing took place at KPPU’s Jakarta headquarters, led by Chairman Moh. Noor Rofieq, alongside Commissioners M. Fanshurullah Asa and Rhido Jusmadi.

The proceedings began with the presentation of the Alleged Violation Report (LDP) by KPPU’s investigative team. The LDP accuses SANY Group of engaging in vertical integration practices and market control. Specifically, SANY International Development, Ltd., and its affiliates—PT Sany Indonesia Machinery, PT Sany Heavy Industry Indonesia, and PT Sany Indonesia Heavy Equipment—allegedly mandated that all purchases of SANY trucks and spare parts go through their Indonesia-based representatives. Furthermore, SANY is accused of cutting off supplies to PT Pusaka Bumi Transportasi (PBT), a non-exclusive dealer, in 2023. This action reportedly pushed PBT out of the market, depriving it of revenue and its ability to serve customers.

KPPU’s investigators allege violations of Articles 14 and 19 of Indonesia’s Competition Law (Law No. 5 of 1999). These articles prohibit anti-competitive agreements and the abuse of market power that could harm competitors or consumers.

After the LDP presentation and examination of supporting evidence, the Commission set February 3, 2025, for the next hearing. This session will provide the accused parties an opportunity to respond to the allegations and for further examination of the evidence.
