The Competition and Markets Authority (CMA) has published (2 January) a new Statement on Transparency and Disclosure, outlining its overarching policies and approach in these areas. The document provides high-level guidance on the CMA’s handling of information, interaction with parties, and collaboration with both UK and international authorities.
Key highlights include:
- The CMA’s transparency objectives during investigations and projects.
- Approaches to information gathering and disclosure to relevant parties.
- Policies for cooperation with UK and overseas public authorities, including under the Digital Markets, Competition and Consumers Act 2024 (DMCCA).
Additionally, the Statement incorporates the CMA’s guidance on overseas investigative assistance (OIA Guidance), approved by the Secretary of State in December 2024, which governs requests for and provision of investigative assistance to foreign authorities.
This guidance reaffirms the CMA’s commitment to balancing transparency with statutory obligations under multiple legal frameworks, including the Enterprise Act 2002 and the Freedom of Information Act 2000. For further information, see the full Statement on the CMA website.
