A new regulation on fines for competition infringements was published in the Official Gazette on December 27, 2024 (No. 32765). Replacing the previous regulation in place since 2009, the updated rules set out how administrative fines will be applied in cases involving anti-competitive agreements, concerted practices, decisions limiting competition, and abuse of dominant position. The distinction between “cartels” and “other violations,” which previously influenced the determination of fines, has been removed. Additionally, aggravating and mitigating factors in the penalty process have been redefined based on recent decisions by the Competition Board. Under the new regulation, the Competition Board has the authority to impose fines of up to 10% of the annual turnover of the companies or associations involved in such violations, in line with Article 16 of the Competition Protection Act No. 4054.
