CADE Fines Medication Cartel $8.3M

The Administrative Council for Economic Defense (CADE) Tribunal has fined (12 December) five companies and five individuals a total of R$ 51.4 million for their involvement in a medication cartel. The group was found guilty of bid-rigging in public procurement processes and engaging in price-fixing practices in the private pharmaceutical market.

Investigation Uncovers Widespread Collusion

The case originated from evidence provided by the Public Prosecutor’s Office of Minas Gerais, which included wiretaps and search-and-seizure operations at several company locations. The investigation revealed frequent coordination among the cartel members to manipulate pricing, terms, and conditions for public procurement bids. This anti-competitive behavior affected markets in multiple states, including Minas Gerais, São Paulo, Bahia, and Pernambuco, between 2007 and 2011.

The cartel also employed a “hub-and-spoke” model, with a central entity facilitating collusion among competitors on pricing, market allocation, and distribution strategies.

Penalties and Further Actions

The fines include over R$ 45 million levied on the companies and more than R$ 6 million imposed on the individuals involved. In addition to the financial penalties, CADE has forwarded the case to federal and state public prosecutors in Mato Grosso, Mato Grosso do Sul, Minas Gerais, Paraná, and São Paulo. These prosecutors may pursue further legal actions to compensate for damages caused to society.
