Spain Probes Alleged Anticompetitive Practices in Insurance Sector

MADRID, Spain, March 6, 2026 — Spain’s National Commission on Markets and Competition (CNMC) has opened an investigation into suspected anticompetitive practices involving insurance companies and insurance brokers.

The authority is examining possible agreements or concerted practices related to coverage in insurance claims, exchanges of information about customers, the fees paid to professionals and potential exclusion of certain professionals from the market.

According to the CNMC, if confirmed, the conduct could constitute an infringement of Article 1.1 of the Spanish Competition Act and Article 101 of the Treaty on the Functioning of the European Union.

As part of the investigation, CNMC officials carried out inspections at the premises of several companies in the sector between February 24 and 26, 2026.

The authority said the inspections represent a preliminary step in the investigation and do not prejudge the outcome of the case or the liability of the companies involved.

The suspected practices could be considered very serious infringements of competition law and may lead to fines of up to 10% of the companies’ total turnover in the financial year preceding the imposition of the penalty.
