Malaysian Authority Proposes Fines on Two Firms Over Highway Tender Bid-Rigging

Kuala Lumpur, January 14, 2026 —The Malaysia Competition Commission has issued a proposed decision against two enterprises for alleged bid rigging in a highway construction tender worth RM 285 million (approximately $40.8 million).

The authority said the companies are provisionally found to have infringed Section 4 of the Competition Act 2010 in connection with the Central Spine Road construction tender issued by the Public Works Department.

Competition Concerns

According to the authority, its investigation found the two enterprises coordinated and shared information while preparing and submitting their bids, amounting to collusion with the object of significantly preventing, restricting, or distorting competition in the public procurement process.

The authority stressed that the proposed decision is provisional and does not constitute a final finding of infringement.

Next Steps

The enterprises have been notified of the proposed penalties and directions and have 30 days to submit written representations. They will also be given an opportunity to make oral representations before the Commission on a date to be set.

The authority said it will issue a final decision only after considering the parties’ submissions alongside the evidence gathered during the investigation.
