Malaysian Authority Provisionally Finds Six Firms Colluded in Prison Tender

Kuala Lumpur, December 23, 2025 — The Malaysia Competition Commission has issued a proposed decision against six enterprises for their alleged involvement in a bid-rigging arrangement linked to procurement by the Kluang Prison Department.

According to the authority, the companies are provisionally found to have coordinated bids relating to 16 quotations and one tender, in breach of Section 4(2)(d) of the Competition Act 2010. The procurement exercises covered contract values ranging from MYR 30,000 to MYR 3 million, with a combined value of MYR 7.3 million (approximately USD 1.55 million).

Alleged cartel conduct

The authority said its investigation found evidence of information exchange among the enterprises and the facilitation of tender and quotation submissions by the same party. These actions were provisionally assessed as having the object of significantly preventing, restricting or distorting competition in public procurement for the prison department.

The alleged conduct relates specifically to bid rigging in the context of government procurement procedures.

Next steps

The Malaysia Competition Commission stressed that the proposed decision represents provisional findings and does not amount to a final determination of infringement. The enterprises concerned have been notified of the proposed penalties and directions and have been granted 30 days to submit written representations.

The companies will also be given the opportunity to make oral representations before the commission at a later date. A final decision will be issued after the authority has considered all representations and the evidence gathered during the investigation.
