Advocate General Medina has recommended that the Court of Justice of the European Union (CJEU) uphold Austria’s appeal against a ruling that dismissed its challenge to Hungary’s state aid for the Paks II nuclear project. In her opinion, delivered on 27 February 2025 in Case C-59/23 P, Medina found several of Austria’s arguments well-founded.
Austria seeks to annul a 2017 European Commission decision that approved Hungary’s financial support for two new reactors at the Paks site. If the CJEU follows the AG’s opinion, the General Court’s 2022 ruling in favor of the Commission could be overturned, potentially impacting Hungary’s nuclear expansion plans.
